SENATE BILL No. 1205

     A bill to require certain state departments to create and

 

implement health savings account options for state employees.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. This act shall be known and may be cited as the "state

 

employee health savings account act".

 

     Sec. 3. As used in this act:

 

     (a) "Health savings account" means a savings or other account

 

meeting the requirements of 26 USC 223.

 

     (b) "High deductible health plan" means that term as defined

 

in 26 USC 223(c)(2).

 

     Sec. 5. The department of civil service and the office of

 

state employer shall establish, as an option that is part of a

 

group benefit plan offered to eligible state employees and their

 


dependents, a health savings account program meeting the

 

requirements for tax incentives for health savings accounts

 

established under title XII of the medicare prescription drug,

 

improvement, and modernization act of 2003.

 

     Sec. 7. The health savings account program shall offer at

 

least 2 high deductible health plan options in conjunction with the

 

use of a health savings account for the deposit of contributions by

 

a state employee and the employee's state employer.  The department

 

may, under rules adopted by the department and in lieu of a high

 

deductible health plan for a state employee, accept the use of a

 

high deductible health insurance policy purchased by the employee.
