SENATE BILL No. 1452

     A bill to amend 1836 PA 25, entitled

 

"An act concerning the records of deeds and other conveyances of

land,"

 

by amending section 1 (MCL 565.581).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. (1)  That  By majority vote, the board of supervisors  

 

or a majority of them,  of  all such  an organized  counties as

 

have been  county that is attached to  other counties  another

 

county for judicial purposes  , are hereby authorized to  may

 

direct the register of deeds of  their  the board's county, either

 

in person or by deputy, to provide  a good and  sufficient  book or  

 

books, and procure and record  therein  in those books a complete

 

copy of all  such  deeds, mortgages, powers of attorney, or other


 

instruments relating to the title of land  as may belong  belonging

 

to  their  the board's county and on record in the county to which

 

it  had been so  is attached.  ; and it shall be the duty of said

 

register or deputy under his oath of office to certify each and

 

every copy so taken to be a true copy of the original record; and

 

such copy so certified shall be received as evidence in all courts

 

of justice in this state, in the same manner and for the same

 

purposes as the original record would be received.

 

     (2) Beginning January 1, 2006, unless state or federal law,

 

rule, regulation, or court order or rule  requires that the social

 

security number appear in the instrument or copies of the

 

instrument, if a register of deeds provides a person a copy of an

 

instrument from a book of records described in subsection (1) that

 

contains a social security number, the register of deeds may

 

obscure or remove all or at least 5 digits of the social security

 

number from the copy before providing it. This subsection does not

 

apply after December 31, 2006.

 

     (3) Beginning January 1, 2007, unless state or federal law,

 

rule, regulation, or court order or rule requires that the social

 

security number appear in the instrument or copies of the

 

instrument, if a register of deeds provides a person a copy of an

 

instrument from a book of records described in subsection (1) that

 

contains a social security number, the register of deeds shall

 

obscure or remove all or at least 5 digits of the social security

 

number from the copy before providing it.

 

     (4) If a register of deeds provides a copy of an instrument

 

from a book of records described in subsection (1), the register of


 

deeds or his or her deputy shall certify that the copy is a true

 

copy of the original record. However, if the register of deeds has

 

obscured or removed social security information from the copy under

 

subsection (2) or (3), the register of deeds or his or her deputy

 

shall include in the certification that social security number

 

information was obscured or removed from the copy.

 

     (5) A copy of an instrument from a book of records that is

 

certified under subsection (4) has the same force and effect as an

 

original for all legal purposes and is admissible in court,

 

administrative proceedings, or elsewhere as evidence in the same

 

manner as an original of the instrument.

 

     Enacting section 1. This amendatory act takes effect January

 

1, 2007.
