A SUMMARY OF SENATE BILL 1227 AS REPORTED BY HOUSE COMMITTEE 12-10-08

Under Part 117 (Septage Waste Services) of the Natural Resources and Environmental Protection Act, the current fee for a septage waste vehicle license is $350 per vehicle per year, provided that none of an applicant's vehicles will be used during the license period to dispose of septage waste by land application.  If any of the applicant's vehicles will be used in that way, the fee is $480 per vehicle per year. 

The bill would amend Part 117 to adopt a reduced transfer fee that would apply, rather than a full new license fee, when the owner of a vehicle with a septage waste vehicle license replaces one of its vehicles.  The transfer fee would be $200 if the vehicle being replaced had already been inspected that year.  If the vehicle being replaced had not yet been inspected, the fee would be $150.  [The license fee is also an inspection fee.  Inspections are handled by local health departments which receive grants from the DEQ for this purpose. When a licensee replaces a vehicle, the new vehicle also must be inspected which is why a higher transfer fee is proposed if the vehicle being replaced had already been inspected.]

FISCAL IMPACT:

The amount of revenue deposited into the Septage Waste Program Fund in any fiscal year would be depend on the number of vehicle permit transfer requests received by the Department.  There would be no fiscal impact on local governmental units.
