A SUMMARY OF SENATE BILL 1227 AS PASSED BY THE SENATE 10-2-08

The current fee for a septage waste vehicle license is $350 per vehicle per year, provided that none of an applicant's vehicles will be used during the license period to dispose of septage waste by spreading it on land.  If any of the applicant's vehicles will be used for the land application of septage waste, the fee is $480 per vehicle per year. 

The bill would amend Part 117 (Septage Waste Services) to establish a transfer fee that would apply, in addition to the annual license fee, when the owner of a vehicle covered by a septage waste vehicle license replaces a vehicle with a different vehicle. The transfer fee would be $200 if the vehicle being replaced had already been inspected that year as required under Part 117.  If the vehicle being replaced had not yet been inspected, the fee would be $150. 

Part 117, specifically, Section 11701(u), MCL 324.11701(u), defines "septage waste" as "the fluid mixture of untreated and partially treated sewage solids, liquids, and sludge of human or domestic origin that is removed from a wastewater system. Septage waste consists only of food establishment septage, domestic septage, domestic treatment plant septage, or sanitary sewer cleanout septage, or any combination of these."

FISCAL IMPACT:

The amount of revenue deposited into the Septage Waste Program Fund in any fiscal year would be depend on the number of vehicle permit transfer requests received by the Department.  There would be no fiscal impact on local governmental units.
