CONTENT
The bill would amend the Worker's Disability Compensation Act to provide that, effective October 1, 2008, an appointee to the Qualifications Advisory Committee would be subject to the advice and consent of the Senate.
The Act requires the Governor to appoint a six-member Qualifications Advisory Committee, consisting of people who have experience in the area of workers' compensation. Employer and employee interests must be represented equally on the Committee. Members serve without compensation, but must be reimbursed for all necessary expenses in connection with the discharge of their official duties as Committee members.
(The Qualifications Advisory Committee, in consultation with the Workers' Compensation Board of Magistrates, must develop a written examination, which must be administered to applicants for the position of magistrate. An applicant for that position must be interviewed by the Committee. After completing personal interviews, the Committee must determine which of the applicants are considered qualified for the position of workers' compensation magistrate. The Committee also must evaluate the performance of each magistrate at least once every two years.
In addition, the Committee is responsible for determining the qualifications of members of the Workers' Compensation Appellate Commission, who are appointed by the Governor with the advice and consent of the Senate.)
