Changes from FY 2006-07 Year-to-Date:
  1. Governor's Recommended Changes. The House concurred with the Governor on all recommended changes, except two noted below. These changes net to an additional $81.9 million, and include $84.9 million for economic adjustments, $28.1 million for 1,400 additional beds, and do not include a net $13.2 million in additional funds provided for in FY 2006-07 supplemental and executive order adjustments. 81,937,900
2. Sentencing Reform. The Governor recommended a reduction of $122.0 million for measures to reduce the prison population and an additional $30.0 million for supervising these offenders in the community. The House reduced savings by $46.0 million. 46,000,000
3. County Jail Reimbursement Program. The Governor recommended a $100 placeholder for the $13.2 million County Jail Reimbursement Program (CJRP). The House appropriated $6.9 million of the civil infraction fees and telephone fees for local jail programs and $4.1 million in civil infraction fees for the CJRP, but did not appropriate $2.2 million in telephone fees and commissions to adjust for historical revenues. 10,999,900
4. Michigan Prisoner Re-entry Initiative (MPRI). The Governor recommended including an additional $20.6 million for the statewide expansion of MPRI. The House added $43.7 million for the MPRI, which is $23.0 million more than the Governor's recommendation. 23,040,600
5. Mental Health and Substance Abuse. The House included $1.9 million for four pilot mental health treatment courts, $1.3 million for an interdepartmental grant to the State Court Administrative Office to fund drug treatment courts for parolees, and $300,000 for an independent study on mental illness and substance abuse prevalence in the prison population. 3,500,000
6. Parole and Probation Special Operations Program. The House eliminated the parole and probation special operations program, which funded Project Joshua and Project Safe Neighborhoods. Executive Order 2007-3 reduced this appropriation in FY 2006-07 from $1.3 million to $650,000, and the Governor recommended $1.3 million for FY 2007-08. (1,300,000)
7. Public Works User Fees. The House doubled the fees local governments and nonprofit agencies pay for prisoner public works crews for an additional $1.8 million in restricted revenue to offset general fund/general purpose. 0
8. Legislative Corrections Ombudsman's Office and Sentencing Guidelines Commission. The House included interdepartmental grants to the Legislative Council for the reestablishment of the Legislative Corrections Ombudsman's Office ($1.3 million) and Sentencing Guidelines Commission ($500,000). 1,750,000
9. Health Care. The House assumed $4.2 million in savings for hospital and specialty care services due to contract changes. (4,196,000)

FY 2007-08 CORRECTIONS BUDGET BOILERPLATE HIGHLIGHTS

Changes from FY 2006-07 Year to Date:
  1. Retained Sections. The House retained 21 of sections that the Governor proposed to delete, including Sections 212, 213, 206, 403, 408, 409, 504, 707, 709, 902(2), 903, 904, 907, 908, 909, 1001, 1007, 1008, 1009, 1010, and 1011. The House also retained the following sections with changes: * ???Section 207 requires plans 120 days prior to start of a privatization initiative and evaluation within 30 months. The House restored it, and added language making all contractors subject to FOIA and audits at the request of Appropriations Committee members, as well as requiring a cost-benefit analysis of the effort, approval of the effort by both Appropriations Committees, cost savings of at least 10%, and expansion of these requirements to contract renewals and extensions.
* ???Section 608 requires a report on the failure rate of parolees involved with the GPS electronic tether program. The House restored it and expanded reporting requirements. * ???Section 902(1) requires semiannual report on health care services and payments. The House changed the frequency and content of the reports, and added a report on the findings of the National Commission on Correctional Health Care.
2. Deletions. The House concurred with the Governor in deleting language requiring that the DOC maintain publicly accessible files of offenders formerly under their jurisdiction in the same manner on OTIS as current offenders (407), requiring a response to the NCCD caseload report (605), and requiring a study to determine the impact of sentencing guidelines (706(4 & 5)). The House also deleted language included by the Governor relating to Project Joshua (607).
3. Contingency Fund Language. The Governor added language allowing the DOC to use contingency fund transfers. The House did not include this section. (Sec. 218)
4. Uniform Cleaning Allowances. The House included intent that no expenditures for uniform cleaning allowances be made and no obligations to pay them be incurred in excess of $250 per employee per year. (Sec. 218)
5. Prisoner Telephone Fees. The House included intent that fee schedules for prisoner telephone services be the same as fee schedules for calls placed from outside of correctional facilities. (Sec. 219)
6. Prison Population Projections. The Governor postponed the projection report date. The House did not concur. (Sec. 401)
7. MPRI Standards. The House required a report on the development of uniform standards for MPRI sites. (Sec. 407)
8. Interdepartmental Grants to the Legislative Council. The House added language allowing for IDGs to the Legislative Council for a Corrections Ombudsman Office and a Sentencing Guidelines Commission. (Sec. 410 & 411)
9. Mental Health & Substance Abuse Report. The House amended language requiring a report on mental health and substance abuse services to require that the State contract with a State university for an independent study of the services and recommendations, and a plan by the DOC to implement the recommendations. (Sec. 412)
10. Parolee Drug Treatment Courts. The House included an IDG to the State Court Administrative Office for drug treatment courts in order to reduce the number of parolees returned to prison and for an independent study of the courts. (Sec. 413)
11. Mental Health Treatment Courts. The House provided for IDGs to the State Court Administrative Office and DCH for four pilot mental health treatment courts and an independent study of the courts. (Sec. 414)
12. Administrative Hearings Officers. The House included language specifying that the funds appropriated for DLEG administrative hearings officers are for adjudicating grievances regarding the DOC. (Sec. 505)
13. Kiosk Reporting. The House required a report on the use of kiosk reporting stations in field offices. (Sec. 609)
14. Field Agents. The House specified that the funds appropriated for additional field agents are to support increased supervision needs in conjunction with the MPRI. (Sec. 610)
15. Sentencing Guidelines Reform Reinvestment. The House added language detailing eligibility criteria for local jail programs associated with sentencing guidelines reforms. (Secs. 703 & 706a)
16. County Jail Reimbursement Program. The Governor deleted language detailing reimbursement and eligibility criteria for the County Jail Reimbursement Program and replaced it with language stating the DOC will determine criteria for this purpose consistent with sentencing reforms to be enacted prior to the start of the fiscal year. The House revised reimbursement criteria to include only prison presumptive felons or parolees who committed felonies. (Sec. 706)
17. Health Care Savings. The House stated that savings were included for hospital and specialty care services to be achieved through contracting and scheduling efficiencies. (Sec. 910)
18. Administrative Segregation. The House required the DOC to review the mental health status of inmates in administrative segregation weekly, and that the DCH clinicians conducting the reviews recommend inmates with serious mental illness be transferred from segregation to a mental health treatment program within 24 hours. (Sec. 911)
19. Public Works User Fees. This language requires the development of a uniform reimbursement rate for public work services provided by offenders. House added intent that any increase in fees charged for the use of prison labor be accompanied by a proportional increase in prisoner pay. (Sec. 1006)
20. Policy Reform Savings. The House required a report on the negative line items and stated that the savings transferred would subject to legislative approval. (Sec. 1101)
21. Field Operations Reinvestment. The House required a report on the Field Operations Reinvestment Program, and reports itemizing its expenditures. (Sec. 1102)
