CONTENT
The bill would amend the Single State Construction Code Act to require the owner, operator, or builder of residential occupancies where the occupants are primarily transient in nature, including boarding houses, hotels, and motels, to install one operational carbon monoxide device with an audible alarm at each source point, beginning December 1, 2009. The requirement would apply only to buildings and structures newly constructed on or after that date. If the International Building Code contained a carbon monoxide device requirement that the Director of the Department of Labor and Economic Growth adopted as part of a code after the bill's effective date, those requirements would apply and would have to be followed upon the code's effective date.

A person who installed a carbon monoxide device in accordance with the manufacturer's published instructions, and the owner or operator who installed or arranged for the installation of and who maintained a device in accordance with the manufacturer's published instructions, would have no liability, directly or indirectly, to any person with respect to the operation, maintenance, or effectiveness of the device.

"Source point" would mean an area where there is a mechanism that provides a common source of heat from a fossil-fuel-burning furnace, boiler, or water heater. The term would not include the presence of a wood or fossil-fuel-burning fireplace or space heater.
