CONTENT
The bill would amend the Legislature Council Act to revise the reporting requirements for the Legislative Commission on Statutory Mandates, and extend the reporting deadlines.


The Act requires the Commission, by December 31, 2008, to review and investigate all funded and unfunded mandates imposed on local units of government in State law; review and investigate all reporting requirements imposed on local units in State law; and determine the complete cost of each funded and unfunded mandate. The Commission must make specific determinations of those items and submit an interim report to the Legislature and the Governor by June 30, 2009.


The bill, instead, would require the Commission, by June 30, 2009, to compile all of the following in an interim report to each house of the Legislature and the Governor: the most significant funded and unfunded mandates and reporting requirements imposed on local units of government in State law as identified by those local units; and the range of cost to local units of complying with each funded and unfunded mandate and each reporting requirement identified by the local units.


Currently, the Commission must make specific determinations of the items described above and report the determinations to the Legislature and the Governor by October 1, 2009. The bill would change that deadline to December 31, 2009. The report would have to include recommendations on how to consolidate, streamline, or eliminate funded and unfunded mandates and reporting requirements. Currently, the Commission must make those recommendations in addition to the report, by December 1, 2009.
