SUBSTITUTE FOR

 

HOUSE BILL NO. 4211

 

 

 

 

 

 

 

 

 

 

 

 

     A bill to amend 1984 PA 431, entitled

 

"The management and budget act,"

 

(MCL 18.1101 to 18.1594) by adding section 229.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 229. (1) Subject to subsection (2), the department shall

 

issue directives to require all buildings and facilities owned or

 

operated by a state agency that are open to the public to provide

 

for the recycling of glass, plastic, and aluminum beverage

 

containers. However, the directives shall require a recycling

 

station only if the station can be placed in a practical location

 

where the building or facility can accommodate the station and

 

obtain recycling services, and where the building or facility would

 

have significant recycling activity.

     (2) If a building or facility owned or operated by a state

 

agency utilizes a privately operated janitorial service, that

 

building or facility shall be subject to the directives issued

 

under subsection (1) on a date occurring after the effective date

 

of this section that is the beginning date of a contract, or

 

renewal of a contract, for janitorial services for that building or

 

facility.

 

     (3) A building or facility leased by a state agency shall be

 

subject to the directives issued under subsection (1) if the

 

facility and lease can accommodate the recycling or as the agency

 

moves into new leases and locations.

     [(4) A CONTRACT FOR RECYCLING SERVICES UNDER THIS SECTION SHALL BE COMPETITIVELY BID. THE DEPARTMENT SHALL REQUIRE THE VENDOR TO PROVIDE ANY NECESSARY RECYCLING CONTAINERS IF IT IS IN THE BEST ECONOMIC INTEREST OF THE STATE.]

     Enacting section 1. This amendatory act takes effect October

 

1, 2009.
