SUBSTITUTE FOR
HOUSE BILL NO. 5467
A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
(MCL 257.1 to 257.923) by adding sections 10a, 64a, 803s, and 803t.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 10a. "Custom vehicle" means a motor vehicle that meets
both of the following criteria:
(a) The vehicle is at least 25 years old and of a model year
after 1948 or was manufactured to resemble a vehicle 25 or more
years old and of a model year after 1948.
(b) The vehicle has been altered from the manufacturer's
original design or has a body constructed from nonoriginal
materials.
Sec. 64a. "Street rod" means a motor vehicle that meets both
of the following criteria:

(a) Is a 1948 or older vehicle or was manufactured after 1948
to resemble a vehicle manufactured before 1949.
(b) Has been altered from the manufacturer's original design
or has a body constructed from nonoriginal materials.
Sec. 803s. (1) The model year and the year of manufacture that
are listed on the certificate of title of a custom vehicle shall be
the model year and year of manufacture that the vehicle body
resembles. [For a replica custom vehicle that was not constructed by a
licensed manufacturer but was constructed or assembled from components, a] certificate of title for a custom vehicle shall
contain in the legend "replica" and shall indicate that the vehicle
is a replica of the model year and year of manufacture listed on
the certificate of title and that year may not represent the actual
year in which the vehicle was assembled.

(2)] In applying for registration of a custom vehicle under
this section, the owner of the custom vehicle shall submit with the
application a certification that the vehicle for which the
application is made meets both of the following criteria:
(a) The vehicle is maintained for occasional transportation,
exhibitions, club activities, parades, tours, and similar uses.
(b) The vehicle is not used for general daily transportation.
[(3)] A person shall not drive or move or the owner shall not
cause or knowingly permit to be driven or moved on a highway a
custom vehicle that is not equipped with lamps and other equipment
in proper condition and adjustment as required in sections 683 to
711.

[(4)] The secretary of state may issue to the owner of a custom
vehicle a custom vehicle registration plate that shall bear the
inscription "custom vehicle – Michigan" and the registration
number.
[(5)] The owner of a custom vehicle applying for a custom
vehicle registration plate or a registration tab under this section
shall pay a fee of $30.00, shall certify that the vehicle for which
the registration is requested is owned and operated solely as a
custom vehicle, and shall certify that the vehicle has been
inspected and found safe to operate on the highways of this state.
[(6)] A registration issued under this section shall expire on
April 15 in the tenth year following the date of issuance of the
registration.
[(7)] The secretary of state may revoke a registration issued
under this section, for cause shown and after a hearing, for
failure of the applicant to comply with this section, for use of
the vehicle for which the registration was issued for purposes
other than those enumerated in this section, or because the vehicle
is not safe to operate on the highways of this state.
[(8)] A vehicle registered under this section is exempt from any
statute that requires periodic vehicle inspections and from any
statute that requires the use and inspection of emission controls.

shall be the model year and year of manufacture that the vehicle
