SENATE SUBSTITUTE FOR
HOUSE BILL NO. 4591
A bill to amend 1976 PA 451, entitled
"The revised school code,"
by amending sections 1538 and 1539 (MCL 380.1538 and 380.1539),
section 1538 as added by 1988 PA 339 and section 1539 as amended
by 2004 PA 76, and by adding sections 1531h and 1538a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1531h. (1) Not later than July 1, 2010, the department
2 shall establish and implement a teacher certification database
3 system that provides for at least all of the following:
4 (a) The ability for teachers to renew a professional
5 teaching certificate online.
6 (b) Online credit card payment capability, to result in
7 processing of teaching certificate applications and issuance of
1 teaching certificates within 48 to 72 hours for in-state
2 applicants and within 3 weeks for out-of-state applicants who
3 have provided a complete application, as determined by the
4 department.
5 (c) A central registry that documents each teacher's
6 professional development activities and completion of state board
7 continuing education units.
8 (d) Improved compatibility with the registry of educational
9 personnel data reporting system.
10 (e) Improved efficiency of the teacher preparation
11 institution web-based teacher certification recommendation
12 process.
13 (f) Improved capacity to generate reports about the number
14 of certificates and endorsements issued.
15 (g) Improved quality control through customization of the
16 system.
17 (2) The department shall fund the system required under
18 subsection (1) from the fee increases in section 1538 that result
19 from the amendatory act that added this section.
20 Sec. 1538. (1) An applicant shall pay the following fees to
21 the department of education, as a condition of for having
the
22 application evaluated for conformance with the application
23 requirements: , the following fees:

19 (2) Except as otherwise provided by an administrative rule
20 in effect on October 1, 1988, or as otherwise provided by law, a
21 certificate, permit, authorization, endorsement, or approval, and
22 the renewal of a certificate, certificate reinstatement, or
23 authorization issued pursuant to subsection (1) is valid for 5
24 years.
25 Sec. 1538a. (1) A teacher preparation institution and its
26 subject area specialty programs shall be approved by the state as
27 provided under R 390.1151 to R 390.1156 of the Michigan
28 administrative code. As provided under R 390.1151 of the Michigan
1 administrative code, and subject to subsection (3), the teacher
2 preparation program and subject area specialty programs of a
3 state-approved teacher preparation institution are subject to
4 periodic review for conformance with state board standards and
5 procedures.
6 (2) A state-approved teacher preparation institution shall
7 pay the following fees to the department for approval and
8 periodic review under subsection (1):
9 (a) For approval or periodic review of a teacher preparation
10 program, the following:
11 (i) If the college or university of which the teacher
12 preparation institution is part has a total student enrollment of
13 less than 2,000, a fee of $2,000.00.
14 (ii) If the college or university of which the teacher
15 preparation institution is part has a total student enrollment of
16 2,000 or more, a fee of $3,500.00.
17 (b) For approval or periodic review of a subject area
18 specialty program, a fee of $300.00.
19 (3) The department shall not conduct a periodic review of a
20 particular teacher preparation program or subject area specialty
21 program more frequently than once every 5 years. However, if the
22 content standards for a subject area specialty program are
23 revised, the department may conduct a periodic review of that
24 subject area specialty program before the 5-year review period
25 has expired.
26 Sec. 1539. (1) A teacher-administrator preparation and
27 certification fund is established in the department of treasury
1 to be administered by the department of education.
2 (2) The department of education shall receive and forward to
3 the state treasurer for deposit in the teacher-administrator
4 preparation and certification fund all fees collected under
5 section 1538 or 1538a. The teacher-administrator preparation and
6 certification fund may receive as revenue money from any other
7 source, as appropriated by the legislature.
8 (3) The revenue in the teacher-administrator preparation and
9 certification fund shall be expended for the operation of the
10 teacher preparation and certification program and the
11 administrator preparation and certification program and for
12 teacher and administrator professional development and other
13 quality-related activities, including the teacher certification
14 database system under section 1531h.
15 (4) Money in the teacher-administrator preparation and
16 certification fund that is unexpended at the end of the state
17 fiscal year shall be carried over to the succeeding state fiscal
18 year, shall not revert to the general fund, and shall be expended
19 as provided in subsection (3).
20 (5) For the state fiscal year ending September 30, 2004,
21 $1,000,000.00 is transferred from the teacher-administrator
22 preparation and certification fund to the unappropriated balance
23 of the general fund for the state fiscal year ending September
24 30, 2004.
