A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 80114a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 80114a. (1) A marine law that prohibits the operation of
a motorized vessel on a portion of the waterways of this state
shall not be enforced against an individual who meets all of the
following qualifications:
(a) The individual has a disability that prevents him or her
from rowing or paddling a vessel.
(b) The individual has in his or her possession a marine
exemption certificate.
(c) The individual is operating a vessel using an electric
motor at slow—no wake speed.
(2) This section does not exempt an individual from compliance
with any other marine law.
(3) An individual may obtain a marine exemption certificate
from a sheriff's department by presenting a physician's attestation
that the physician has examined the individual and determined that
the individual has a disability that prevents him or her from
rowing or paddling a vessel.
(4) The department shall develop and make available for use as
prescribed in this section a physician's attestation form and a
marine exemption certificate.
