     A bill to amend 1897 PA 205, entitled

 

"An act to prefer honorably discharged members of the armed forces

of the United States for public employments,"

 

by amending section 1 (MCL 35.401).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. In every public department and upon the public works

 

of the state and of every county and municipal corporation thereof

 

of this state, an honorably discharged veteran, as defined by Act

 

No. 190 of the Public Acts of 1965, as amended, being sections

 

35.61 and 35.62 of the Michigan Compiled Laws 1965 PA 190, MCL

 

35.61 to 35.62, shall be preferred for appointment and employment.

 

Age, loss of limb, or other physical impairment which that does

 

not, in fact, incapacitate, shall not be deemed to does not

 

disqualify them. When it shall become If it is necessary to fill by

 

appointment a vacancy occurring in an elective office, the


 

appointment shall be deemed to be is within this act. The applicant

 

shall be of good moral character and shall have been a resident of

 

the state for at least 2 years and of the county in which the

 

office or position is located for at least one year, and possess

 

other requisite qualifications, after credit allowed by the

 

provisions of any civil service laws. In any instance where If

 

there is a conflict between the provisions of this act and Act No.

 

370 of the Public Acts of 1941, as amended, being sections 38.401

 

to 38.428 of the Michigan Compiled Laws 1941 PA 370, MCL 38.401 to

 

38.428, the provisions of Act No. 370 of the Public Acts of 1941,

 

as amended 1941 PA 370, MCL 38.401 to 38.428, shall prevail.
