SUBSTITUTE FOR

 

SENATE BILL NO. 348

 

 

 

 

 

 

 

 

 

 

 

 

 

     A bill to establish the Amanda's fund for breast cancer

 

research in the department of community health; to provide for the

 

distribution of money from the fund; to prescribe the duties and

 

powers of certain agencies and officials; and to provide for

 

appropriations.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. This act shall be known and may be cited as the

 

"Amanda's fund for breast cancer research act".

 

     Sec. 2. As used in this act:

 

     (a) "Department" means the department of community health.

 

     (b) "Fund" means the Amanda's fund for breast cancer research

 

created in section 3.

 

     Sec. 3. (1) The Amanda's fund for breast cancer research is

 


created in the department to provide funds to promote research in

 

this state relating to breast cancer.

 

     (2) The state treasurer shall credit to the fund all amounts

 

appropriated for this purpose under section 435 of the income tax

 

act of 1967, 1967 PA 281, MCL 206.435.

 

     (3) The fund shall consist of the money credited to the fund

 

pursuant to section 435 of the income tax act of 1967, 1967 PA 281,

 

MCL 206.435, any interest and earnings accruing from the saving and

 

investment of that money, and other appropriations, money, or other

 

things of value received by the fund.

 

     (4) The state treasurer shall direct the investment of the

 

fund.

 

     (5) Money in the fund at the close of the year shall remain in

 

the fund and shall not lapse to the general fund.

 

     Sec. 4. (1) The money, interest, and earnings of the fund

 

shall be expended solely for the purposes described in this act.

 

     (2) Money granted or received as a gift or donation to the

 

fund is available for distribution upon appropriation.

 

     Sec. 5. The department shall do all of the following with the

 

money from the fund:

 

     (a) Support the development of a statewide breast cancer

 

research plan.

 

     (b) Provide information to the public about the value of

 

breast cancer research and early detection.

 

     (c) Develop and publicize criteria for proposals to be funded

 

under this act.

 

     (d) Review and approve proposals to be funded under this act.

 


     Sec. 6. (1) The department shall determine which proposals to

 

fund with money from the fund. The department shall solicit

 

proposals and approve proposals for funding under this act.

 

Proposals may be submitted only by individuals, groups, and

 

institutions with an interest in breast cancer research activities.

 

     (2) The department shall review and approve proposals

 

submitted for funding under this act and shall give priority to

 

proposals submitted by applicants that are located in this state

 

and that conduct the research or other activity that is the basis

 

for the proposal in this state. The money in the fund shall be used

 

to fund, but is not limited to funding, the following types of

 

programs:

 

     (a) Proposals for applied breast cancer research.

 

     (b) Community education programs to raise awareness through

 

county, city, or township programs.

 

     Sec. 7. Money from the fund may be used as matching funds for

 

a federal grant or a grant from the national cancer institute.

 

     Sec. 8. The money in the fund that is available for

 

distribution shall be appropriated each year. If money remains in

 

the fund at the close of the state fiscal year, that money shall

 

remain in the fund and shall not lapse to the general fund.

 

     Enacting section 1. This act does not take effect unless

 

Senate Bill No. 347 of the 94th Legislature is enacted into law.
