SUBSTITUTE FOR

SENATE BILL NO. 442

     A bill to amend 1994 PA 451, entitled

"Natural resources and environmental protection act,"

by amending section 40105 (MCL 324.40105), as added by 1995 PA 57.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

     Sec. 40105. (1) All animals found in this state, whether

resident or migratory and whether native or introduced, are the

property of the people of the state, and the taking of all animals

shall be regulated by the department or commission as provided by

law.

     (2) In furtherance of section 52 of article IV of the state

constitution of 1963, the department shall protect and promote the

people's right to lawfully hunt, trap, and harvest game that is the

property of the people of the state.
