SENATE BILL No. 1041

 

 

January 22, 2008, Introduced by Senators RICHARDVILLE, BIRKHOLZ, PAPPAGEORGE, KAHN, BISHOP, SANBORN, ANDERSON, BASHAM, ALLEN, HARDIMAN, SWITALSKI, JANSEN and KUIPERS and referred to the Committee on Energy Policy and Public Utilities.

 

 

 

     A bill to amend 1939 PA 3, entitled

 

"An act to provide for the regulation and control of public and

certain private utilities and other services affected with a public

interest within this state; to provide for alternative energy

suppliers; to provide for licensing; to include municipally owned

utilities and other providers of energy under certain provisions of

this act; to create a public service commission and to prescribe

and define its powers and duties; to abolish the Michigan public

utilities commission and to confer the powers and duties vested by

law on the public service commission; to provide for the

continuance, transfer, and completion of certain matters and

proceedings; to abolish automatic adjustment clauses; to prohibit

certain rate increases without notice and hearing; to qualify

residential energy conservation programs permitted under state law

for certain federal exemption; to create a fund; to provide for a

restructuring of the manner in which energy is provided in this

state; to encourage the utilization of resource recovery

facilities; to prohibit certain acts and practices of providers of

energy; to allow for the securitization of stranded costs; to

reduce rates; to provide for appeals; to provide appropriations; to

declare the effect and purpose of this act; to prescribe remedies

and penalties; and to repeal acts and parts of acts,"

Senate Bill No. 1041 as amended March 26, 2008

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 10dd. (1) After notice and hearing, the commission shall

 

issue orders requiring all electric suppliers in this state to

 

offer green energy programs to their customers.

 

     (2) An electric supplier shall include on each customer's bill

 

the price differential for each kilowatt hour of electricity

 

purchased from the green energy program compared to the purchase of

 

nonrenewable electricity. An electric supplier shall inform each

 

customer on their bill that an income tax credit is available for

 

the purchase of green energy as provided in section 253 of the

 

income tax act of 1967, 1967 PA 281, MCL 206.253.

 

     (3) As used in this section:

 

     (a) "Green energy programs" means programs that allow

 

customers to purchase electricity generated from renewable energy

 

sources.

 

     (b) "Renewable energy sources" means <<a resource that naturally

 

replenishes over a human, not a geological, time frame ultimately derived

 

from solar power, solar hot water, or wind power. A renewable energy

 

source comes from the sun or from thermal inertia of the ground and

 

minimizes the output of toxic material in the conversion of the energy.
