      A bill to amend 1976 PA 451, entitled

 

"The revised school code,"

 

by amending sections 1538 and 1539 (MCL 380.1538 and 380.1539),

 

section 1538 as added by 1988 PA 339 and section 1539 as amended

 

by 2004 PA 76, and by adding section 1538a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

 1        Sec. 1538. (1) An applicant shall pay the following fees to

 

 2  the department of education, as a condition of for having the

 

 3  application evaluated for conformance with the application

 

 4  requirements: , the following fees:

20        (2) Except as otherwise provided by an administrative rule

 

21  in effect on October 1, 1988, or as otherwise provided by law, a

 

22  certificate, permit, authorization, endorsement, or approval, and

 

23  the renewal of a certificate, certificate reinstatement, or

 

24  authorization issued pursuant to subsection (1) is valid for 5

 

25  years.

 

26        Sec. 1538a. (1) A teacher preparation institution shall be

 

27  approved by the state as provided under R 390.1151 to R 390.1156

 

28  of the Michigan administrative code.

 


 1        (2) As provided under R 390.1151 of the Michigan

 

 2  administrative code, the teacher preparation program and subject

 

 3  area specialty programs of a state-approved teacher preparation

 

 4  institution are subject to periodic review for conformance with

 

 5  state board standards and procedures. A state-approved teacher

 

 6  preparation institution shall pay the following fees to the

 

 7  department for this periodic review:

 

 8        (a) For periodic review of a teacher preparation program,

 

 9  the following:

 

10        (i) If the college or university of which the teacher

 

11  preparation institution is part has a total student enrollment of

 

12  less than 2,000, a fee of $2,000.00.

 

13        (ii) If the college or university of which the teacher

 

14  preparation institution is part has a total student enrollment of

 

15  2,000 or more, a fee of $3,500.00.

 

16        (b) For periodic review of a subject area specialty program,

 

17  a fee of $300.00.

 

18        Sec. 1539. (1) A teacher-administrator preparation and

 

19  certification fund is established in the department of treasury

 

20  to be administered by the department of education.

 

21        (2) The department of education shall receive and forward to

 

22  the state treasurer for deposit in the teacher-administrator

 

23  preparation and certification fund all fees collected under

 

24  section 1538 or 1538a. The teacher-administrator preparation and

 

25  certification fund may receive as revenue money from any other

 

26  source, as appropriated by the legislature.

 

27        (3) The revenue in the teacher-administrator preparation and

 


 1  certification fund shall be expended for the operation of the

 

 2  teacher preparation and certification program and the

 

 3  administrator preparation and certification program and for

 

 4  teacher and administrator professional development and other

 

 5  quality-related activities.

 

 6        (4) Money in the teacher-administrator preparation and

 

 7  certification fund that is unexpended at the end of the state

 

 8  fiscal year shall be carried over to the succeeding state fiscal

 

 9  year, shall not revert to the general fund, and shall be expended

 

10  as provided in subsection (3).

 

11        (5) For the state fiscal year ending September 30, 2004,

 

12  $1,000,000.00 is transferred from the teacher-administrator

 

13  preparation and certification fund to the unappropriated balance

 

14  of the general fund for the state fiscal year ending September

 

15  30, 2004.
