      A bill to amend 1994 PA 451, entitled

 

"Natural resources and environmental protection act,"

 

by amending sections 43521, 43523, 43524, 43525, 43525a, 43526,

 

43527, 43528, 43529, 43530, 43531, and 43535 (MCL 324.43521,

 

324.43523, 324.43524, 324.43525, 324.43525a, 324.43526,

 

324.43527, 324.43528, 324.43529, 324.43530, 324.43531, and

 

324.43535), sections 43521, 43526, 43528, 43529, 43531, and 43535

 

as amended by 1996 PA 585, sections 43523, 43525, 43525a, and

 

43527 as amended by 2006 PA 280, section 43524 as amended by 2002

 

PA 81, and section 43530 as amended by 2001 PA 23; and to repeal

 

acts and parts of acts.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

 1        Sec. 43521. (1) Notwithstanding any other section provision

 

 2  of this part, the department commission, by order issued in the


 

 1  manner provided in section 40113a, may discount the price of a

 

 2  license. for the following purposes:

 

 3        (a) For marketing purposes to increase participation in

 

 4  hunting and fishing activities. The price of a license shall not

 

 5  be discounted more than 15% for marketing purposes.

 

 6        (b) The price of the antlerless deer license may be reduced

 

 7  or eliminated in specific areas to help achieve the harvest of

 

 8  antlerless deer.

 

 9        (c) If a person purchases 4 or more licenses for the same

 

10  person at the same time, a sportsperson discount of 15% shall be

 

11  provided. Waterfowl hunting licenses and limited fishing licenses

 

12  are not eligible for the sportsperson discount.

 

13        (2) Subject to subsection (4), beginning March 1, 2012, the

 

14  fees under this part are increased 5% over the fees specified in

 

15  this part for 2010.

 

16        (3) Subject to subsection (4), beginning March 1, 2013, the

 

17  fees under this part are increased 5% over the fees provided for

 

18  in subsection (2).

 

19        (4) Subsections (2) and (3) do not apply to fees for

 

20  licenses described in this part as nonresident licenses or to

 

21  fees for senior citizen licenses under section 43533. If a fee

 

22  under this part is expressed as a percentage of another fee,

 

23  subsections (2) and (3) do not increase the percentage.

 

24        Sec. 43523. (1) Except as otherwise provided in this part, a

 

25  person shall not hunt small game without a current small game

 

26  license. Each small game license authorizes the person named in

 

27  the license to hunt for small game except for animals or birds


 

 1  that require a special license. If authorized in an order issued

 

 2  under part 401, a resident person possessing a current small game

 

 3  license may take specified fur-bearing animals by means other

 

 4  than trapping during the open season for hunting these fur-

 

 5  bearing animals. The fee for a small game license is as follows:

 

 6        (a) Subject to Except as provided in subdivision (b), for a

 

 7  resident: , $15.00.

 

 8        (i) In 2007, $16.25.

 

 9        (ii) In 2008, $17.50.

 

10        (iii) In 2009, $18.75.

 

11        (iv) Beginning in 2010, $20.00.

 

12        (b) For a resident or nonresident minor child, $1.00 50% of

 

13  the fee for a resident small game license, rounded to the nearest

 

14  25 cents.

 

15        (c) Subject to Except as provided in subdivision (b), for a

 

16  nonresident, $69.00 $100.00. However, a nonresident may purchase

 

17  a limited nonresident small game license entitling that person to

 

18  hunt for a 3-day period all species of small game that are

 

19  available to hunt under a nonresident small game license. The fee

 

20  for a limited nonresident small game license is $30.00 $40.00.

 

21        (2) A small game license is void between the hours of 1/2

 

22  hour after sunset and 1/2 hour before sunrise.

 

23        Sec. 43524. (1) A person shall not hunt wild turkey without

 

24  a current wild turkey hunting license. The license shall be

 

25  issued for a specified hunting period.

 

26        (2) The fee for a resident wild turkey hunting license is

 

27  $15.00. The fee for a nonresident wild turkey hunting license is


 

 1  $69.00. as follows:

 

 2        (a) For a resident:

 

 3        (i) In 2007, $18.75.

 

 4        (ii) In 2008, $22.50.

 

 5        (iii) In 2009, $26.25.

 

 6        (iv) Beginning in 2010, $30.00.

 

 7        (b) For a nonresident, $140.00.

 

 8        (3) Subject to the requirements of section 40113a, the

 

 9  commission may issue an order requiring that all applications for

 

10  wild turkey hunting licenses, or applications for wild turkey

 

11  hunting licenses for certain geographic areas, be entered into a

 

12  lottery designed and run by the department. A person selected in

 

13  a lottery, upon meeting the requirements of this part, is

 

14  authorized to purchase a wild turkey hunting license. The license

 

15  shall be issued for a specified hunting period and shall confer

 

16  upon the holder of the license the right to hunt wild turkeys.

 

17        (2) The department may charge a nonrefundable application

 

18  fee not to exceed $4.00 $5.00 for each application for a wild

 

19  turkey hunting license that is entered into a lottery pursuant to

 

20  this subsection. (1).

 

21        (4) (3) From fees collected under subsection (1) or (2) this

 

22  section, the following amounts shall be used for scientific

 

23  research, biological survey work on wild turkeys, and wild turkey

 

24  management in this state:

 

 

25      (a) Resident wild turkey hunting license............... $ 9.50

26      (b) Nonresident wild turkey hunting license............ $50.00


     (c) Senior wild turkey hunting license................. $ 1.00

     (d) Wild turkey hunting application........... amount of appli-

                                                    cation fee, if

                                                  any, but not more

                                                       than $ 3.00.

 

 

 6        Sec. 43525. (1) A person 16 years of age or older shall not

 

 7  hunt waterfowl without a current waterfowl hunting license issued

 

 8  by this state. The annual license requirement is in addition to

 

 9  the requirements for a small game license and federal migratory

 

10  bird hunting stamp. The fee for the waterfowl hunting license is

 

11  $5.00. as follows:

 

12        (a) In 2007, $6.25.

 

13        (b) In 2008, $7.50.

 

14        (c) In 2009, $8.75.

 

15        (d) Beginning in 2010, $10.00.

 

16        (2) If issued as a stamp, a waterfowl hunting license shall

 

17  be affixed to the small game license of the person and signed

 

18  across the face of the stamp by the person to whom it is issued.

 

19        (3) A collector may purchase a waterfowl hunting license, if

 

20  it is issued as a stamp, without being required to place it on a

 

21  small game license, sign across its face, or provide proof of

 

22  competency under section 43520(2). However, a license described

 

23  in this subsection is not valid for hunting waterfowl.

 

24        (4) A person shall not hunt waterfowl, or deer if deer

 

25  hunting is regulated by permit, in an area designated by the

 

26  department as a managed waterfowl area, without an annual or

 

27  daily managed waterfowl area permit and any other license or


 

 1  permit required by this part.

 

 2        (5) The fee for a daily managed waterfowl area permit is

 

 3  $4.00. as follows:

 

 4        (a) In 2007, $4.75.

 

 5        (b) In 2008, $5.50.

 

 6        (c) In 2009, $6.25.

 

 7        (d) Beginning in 2010, $7.00.

 

 8        (6) The fee for an annual managed waterfowl area permit is

 

 9  $13.00. as follows:

 

10        (a) In 2007, $14.75.

 

11        (b) In 2008, $16.50.

 

12        (c) In 2009, $18.25.

 

13        (d) Beginning in 2010, $20.00.

 

14        (7) (5) Following a lottery among applicants for hunting

 

15  privileges in managed waterfowl areas, only those successful

 

16  applicants who accept the hunting privileges are required to

 

17  purchase a daily or annual managed waterfowl area permit.

 

18        (8) (6) From the fee collected for each waterfowl hunting

 

19  license, $3.50 shall be used to acquire wetlands and other lands

 

20  to be managed for the benefit of waterfowl.

 

21        (9) (7) The following amounts from the fee collected for

 

22  each annual or daily managed waterfowl area permit sold shall be

 

23  used to operate, maintain, and develop managed waterfowl areas in

 

24  this state:

 

 

25      (a) Daily managed waterfowl area permit...........     $ 3.00.

26      (b) Annual managed waterfowl area permit..........     $10.00.


 

 

 1        (10) (8) The department shall charge a nonrefundable

 

 2  application fee not to exceed $4.00 $5.00 for each person who

 

 3  applies application for a permit to hunt in a reserved drawing

 

 4  hunt in a managed waterfowl area.

 

 5        Sec. 43525a. (1) The department shall issue a combination

 

 6  deer license that authorizes a person to hunt deer both during

 

 7  the firearm deer seasons and the bow and arrow seasons, in

 

 8  compliance with the rules established for the respective deer

 

 9  hunting season. A combination deer license shall authorize the

 

10  holder to take 2 deer in compliance with orders issued under part

 

11  401.

 

12        (2) The fee for a resident combination deer license is the

 

13  total of the resident firearm deer license fee plus the fee for a

 

14  second resident bow and arrow deer license. fee. The fee for a

 

15  nonresident combination deer license is the total of the

 

16  nonresident firearm deer license fee plus the nonresident bow and

 

17  arrow deer license fee. However, the fee for a combination deer

 

18  license for a resident or nonresident minor child shall be

 

19  discounted 50% from the cost of the resident combination deer

 

20  license is 50% of the sum of the resident firearm deer license

 

21  fee plus the resident bow and arrow deer license fee, rounded to

 

22  the nearest 25 cents.

 

23        (3) If advisable in managing deer, an order under part 401

 

24  may designate the kind of deer that may be taken and the

 

25  geographic area in which any license issued under this section is

 

26  valid.

 


 1        (4) The department may issue kill tags with or as part of

 

 2  each combination deer license. Each kill tag shall bear the

 

 3  license number. A kill tag may also include space for other

 

 4  pertinent information required by the department. A kill tag, if

 

 5  issued, is part of the license and shall not be used more than 1

 

 6  time.

 

 7        (5) The combination deer license shall count as 2 licenses

 

 8  for the purposes of license fees under section 43536a ,

 

 9  discounting under subsection 43521(c), and the transmittal,

 

10  deposit, and use of fees under sections 43554 and 43555.

 

11        (6) A senior citizen may obtain a senior combination deer

 

12  license. The fee for a senior combination deer license shall be

 

13  discounted at the same rate is a percentage, as provided in

 

14  section 43535, of the sum of the resident firearm deer license

 

15  fee plus the resident bow and arrow deer license fee, rounded to

 

16  the nearest 25 cents.

 

17        (7) A combination deer license issued to a person less than

 

18  12 years of age is valid only for taking deer with a bow and

 

19  arrow, until the person is 12 years of age or older.

 

20        (8) Notwithstanding any other provision of this part, except

 

21  for replacing lost or destroyed licenses, a person shall not

 

22  apply for, obtain, or purchase any combination of firearm deer

 

23  licenses, bow and arrow deer licenses, and combination deer

 

24  licenses that would authorize the taking of more than 2 deer.

 

25        Sec. 43526. (1) A person shall not hunt deer during the

 

26  firearm deer season without purchasing a current firearm deer

 

27  license. The fee for a resident firearm deer license is $13.00.

 


 1  Beginning in 1999, the fee for a resident firearm deer license is

 

 2  $14.00. Beginning in 2001, the fee for a resident firearm deer

 

 3  license is $15.00. The fee for a nonresident firearm deer license

 

 4  is $120.00. Beginning in 1999, the fee for a nonresident firearm

 

 5  deer license is $129.00. Beginning in 2001, the fee for a

 

 6  nonresident firearm deer license is $138.00. as follows:

 

 7        (a) Except as provided in subdivision (b), for a resident:

 

 8        (i) In 2007, $18.75.

 

 9        (ii) In 2008, $22.50.

 

10        (iii) In 2009, $26.25.

 

11        (iv) Beginning in 2010, $30.00.

 

12        (b) For a minor child, 50% of the fee for a resident firearm

 

13  deer license, rounded to the nearest 25 cents.

 

14        (c) Except as provided in subdivision (b), for a

 

15  nonresident, $165.00.

 

16        (2) Where authorized by the department, a resident or

 

17  nonresident may purchase a second firearm deer license in 1

 

18  season. for the fee assessed under this subsection for the

 

19  firearm deer license for which that person is eligible. However,

 

20  a A senior license discount is not available for the purchase of

 

21  a second firearm deer license. The fee for a second firearm deer

 

22  license is as follows:

 

23        (a) Except as provided in subdivision (b), for a resident:

 

24        (i) In 2007, $22.50.

 

25        (ii) In 2008, $30.00.

 

26        (iii) In 2009, $37.50.

 

27        (iv) In 2010, $45.00.

 


 1        (b) For a minor child, 50% of the fee for a resident firearm

 

 2  deer license, rounded to the nearest 25 cents.

 

 3        (c) Except as provided in subdivision (b), for a

 

 4  nonresident, $165.00.

 

 5        (3) The department may issue orders under part 401

 

 6  designating the kind of deer that may be taken and the geographic

 

 7  area in which any license issued under this section is valid,

 

 8  when advisable in managing deer.

 

 9        (4) (2) The department may issue a kill tag with or as part

 

10  of each deer license. The kill tag shall bear the license number.

 

11  The kill tag may also include space for other pertinent

 

12  information required by the department. The kill tag, if issued,

 

13  is part of the license.

 

14        (5) (3) The department shall charge a nonrefundable

 

15  application fee not to exceed $4.00 $5.00 for each person who

 

16  applies for an antlerless deer license. Except as otherwise

 

17  provided in section 43521, the The fee for a resident an

 

18  antlerless deer license is $13.00. Beginning in 1999, the fee for

 

19  a resident antlerless deer license is $14.00. Beginning in 2001,

 

20  the fee for a resident antlerless deer license is $15.00. The fee

 

21  for a nonresident antlerless deer license is $120.00. Beginning

 

22  in 1999, the fee for a nonresident antlerless deer license is

 

23  $129.00. Beginning in 2001, the fee for a nonresident antlerless

 

24  deer license is $138.00. as follows:

 

25        (a) Except as provided in subdivision (b), for a resident:

 

26        (i) In 2007, $18.75.

 

27        (ii) In 2008, $22.50.

 


 1        (iii) In 2009, $26.25.

 

 2        (iv) Beginning in 2010, $30.00.

 

 3        (b) For a minor child, 50% of the fee for a resident

 

 4  antlerless deer license, rounded to the nearest 25 cents.

 

 5        (c) Except as provided in subdivision (b), for a

 

 6  nonresident, $100.00.

 

 7        Sec. 43527. (1) A person shall not hunt deer with a bow and

 

 8  arrow or crossbow during the bow and arrow deer season without a

 

 9  current bow and arrow deer license. The fee for a resident bow

 

10  and arrow deer license is $15.00. The fee for a resident or

 

11  nonresident minor child for a bow and arrow deer license shall be

 

12  discounted 50% from the cost of the resident bow and arrow deer

 

13  license. The fee for a nonresident bow and arrow deer license is

 

14  $138.00. as follows:

 

15        (a) Except as provided in subdivision (b), for a resident:

 

16        (i) In 2007, $18.75.

 

17        (ii) In 2008, $22.50.

 

18        (iii) In 2009, $26.25.

 

19        (iv) Beginning in 2010, $30.00.

 

20        (b) For a minor child, 50% of the fee for a resident bow and

 

21  arrow deer license, rounded to the nearest 25 cents.

 

22        (c) Except as provided in subdivision (b), for a

 

23  nonresident, $165.00.

 

24        (2) Where authorized by the department, a person may

 

25  purchase a second bow and arrow deer license in 1 season. for the

 

26  fee assessed under subsection (1) for the bow and arrow deer

 

27  license for which that person is eligible. However, a A senior

 9        (b) For a minor child, 50% of the fee for a resident bow and

 

10  arrow deer license fee, rounded to the nearest 25 cents.

 

11        (c) Subject to subdivision (b), for a nonresident, $165.00.

 

12        (3) The department may issue orders under part 401

 

13  designating the kind of deer that may be taken and the geographic

 

14  area in which any license issued under this section is valid, if

 

15  advisable in managing deer.

 

16        (4) (3) The department may issue a kill tag with, or as a

 

17  part of, each bow and arrow deer license. Section 43526(2)

 

18  43526(4) applies with respect to a bow and arrow deer license.

 

19        Sec. 43528. (1) A person shall not hunt bear without a

 

20  current bear hunting license. The fee for a resident bear hunting

 

21  license is $13.00. Beginning in 1999, the fee for a resident bear

 

22  hunting license is $14.00. Beginning in 2001, the fee for a

 

23  resident bear hunting license is $15.00. The fee for a

 

24  nonresident bear hunting license is $150.00. as follows:

 

25        (a) For a resident:

 

26        (i) In 2007, $23.75.

 

27        (ii) In 2008, $32.50.

 


 1        (iii) In 2009, $41.25.

 

 2        (iv) Beginning in 2010, $50.00.

 

 3        (b) For a nonresident, $300.00.

 

 4        (2) The department may issue a tag with, or as a part of, a

 

 5  bear hunting license. Section 43526(2) 43526(4) applies with

 

 6  respect to a bear hunting license.

 

 7        (3) In addition to the license fees in subsection (1), the

 

 8  department shall charge a nonrefundable application fee not to

 

 9  exceed $4.00 $5.00 for each person who applies for a bear hunting

 

10  license.

 

11        Sec. 43529. (1) A resident person shall not hunt elk during

 

12  the elk season without an a current elk hunting license, which

 

13  shall be issued only to a resident. The fee for an elk hunting

 

14  license is $100.00. as follows:

 

15        (a) In 2007, $125.00.

 

16        (b) In 2008, $150.00.

 

17        (c) In 2009, $175.00.

 

18        (d) Beginning in 2010, $200.00.

 

19        (2) The department may establish a nonrefundable application

 

20  fee not to exceed $4.00 $5.00 for each person who applies for an

 

21  elk hunting license.

 

22        (3) (2) The department may issue a kill tag with, or as a

 

23  part of, an elk hunting license. Section 43526(2) 43526(4)

 

24  applies with respect to an elk hunting license.

 

25        Sec. 43530. (1) A person shall not hunt small game on game

 

26  bird hunting preserves licensed under part 417 without a current

 

27  small game license as provided in section 43523 . However,

 


 1  instead of a small game license, a person may obtain a special or

 

 2  a game bird hunting preserve license. for a fee of $15.00. The

 

 3  fee for a game bird hunting preserve license is as follows:

 

 4        (a) In 2007, $16.25.

 

 5        (b) In 2008, $17.50.

 

 6        (c) In 2009, $18.75.

 

 7        (d) Beginning in 2010, $20.00.

 

 8        (2) Each game bird hunting preserve license shall have

 

 9  specify the date of issue affixed to the license and shall

 

10  authorize the holder to hunt only on licensed game bird hunting

 

11  preserves and only for captive-reared game bird species for which

 

12  the game bird hunting preserve is licensed.

 

13        Sec. 43531. (1) Except as otherwise provided in section

 

14  43523(1), a person shall not trap or hunt fur-bearing animals

 

15  without purchasing and possessing a fur harvester's license. The

 

16  fee for a resident fur harvester's license is $13.00. Beginning

 

17  in 1999, the fee for a resident fur harvester's license is

 

18  $14.00. Beginning in 2001, the fee for a resident fur harvester's

 

19  license is $15.00. The fee for as follows:

 

20        (a) Except as provided in subdivision (b), for a resident:

 

21        (i) In 2007, $16.25.

 

22        (ii) In 2008, $17.50.

 

23        (iii) In 2009, $18.75.

 

24        (iv) Beginning in 2010, $20.00.

 

25        (b) For a resident or nonresident person who is 12 years of

 

26  age through 16 years of age, for a fur harvester's license shall

 

27  be discounted 50% from the cost 50% of the fee for a resident fur

 


 1  harvester's license, rounded to the nearest 25 cents.

 

 2        (c) Except as provided in subdivision (b) and subject to

 

 3  this subdivision, for a nonresident, $200.00.

 

 4        (2) The department may issue a nonresident fur harvester's

 

 5  license to a nonresident of this state if the state, province, or

 

 6  country in which the nonresident applicant resides allows

 

 7  residents of this state to obtain equivalent hunting and trapping

 

 8  privileges in that state, province, or country. The fee for an

 

 9  eligible nonresident fur harvester's license is $150.00.

 

10  Nonresident fur harvester's licenses shall not be sold or

 

11  purchased prior to November 15 of each year.

 

12        (2) (3) A person who holds a fur harvester's license may

 

13  hunt fur-bearing animals during the season open to taking fur-

 

14  bearing animals with firearms and may trap fur-bearing animals

 

15  during the season open to trapping fur-bearing animals.

 

16        Sec. 43535. A resident of this state who is 65 years of age

 

17  or older may obtain a senior small game license, a senior firearm

 

18  deer license, a senior bow and arrow deer license, a senior bear

 

19  hunting license, a senior wild turkey hunting license, or a

 

20  senior fur harvester's license. The fee for each senior license

 

21  shall be discounted 60% from the fee for the resident license.

 

22  the following percentage of the fee for the corresponding

 

23  resident license, rounded to the nearest 25 cents:

 

24        (a) Before 2010, 40%.

 

25        (b) In 2010, 45%.

 

26        (c) In 2011, 50%.

 

27        (d) In 2012, 55%.

 


 1        (e) Beginning in 2013, 60%.

 

 2        Enacting section 1. Section 43522a of the natural resources

 

 3  and environmental protection act, 1994 PA 451, MCL 324.43522a, is

 

 4  repealed.
