A bill to create the Michigan summer sweep program; to
prescribe the powers and duties of certain state departments; and
to establish a fund and provide for the administration of that
fund.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. This act shall be known and may be cited at the
"Michigan summer sweep program act".
Sec. 2. As used in this act:
(a) "Department" means the state transportation department.
(b) "Eligible low-income student" means a person who meets all
of the following requirements:
(i) Is a member of a household the gross annual income of which
is equal to or less than the official poverty line for the same
size household as defined by the office of management and budget
and issued by the United States secretary of health and human
services pursuant to section 673(2) of the community services block
grant act, subtitle B of title VI of the omnibus budget
reconciliation act of 1981, 42 USC 9902.
(ii) Is not less than 15 years old and is not more than 17
years old.
(iii) Is enrolled in high school and is making satisfactory
academic progress as determined by his or her grades and his or her
scores on the Michigan education assessment program (MEAP) tests
administered pursuant to the revised school code, 1976 PA 451, MCL
380.1 to 380.1852.
Sec. 3. Within 90 days after the effective date of this act,
the department shall develop and implement a statewide program to
employ eligible low-income students in street and highway
beautification projects. The program shall be known as the
"Michigan summer sweep program".
Sec. 4. (1) An eligible low-income student may apply to
participate in the Michigan summer sweep program by submitting an
application to the department on a form prescribed by the
department.
(2) The department shall develop an application form for the
Michigan summer sweep program and shall distribute those
applications to all high schools in this state.
Sec. 5. (1) The Michigan summer sweep program fund is created
within the state treasury.
(2) The state treasurer may receive money or other assets from
any source for deposit into the fund. The state treasurer shall
direct the investment of the fund. The state treasurer shall credit
to the fund interest and earnings from fund investments.
(3) Money in the fund at the close of the fiscal year shall
remain in the fund and shall not lapse to the general fund.
(4) The department shall be the administrator of the fund for
auditing purposes.
(5) The department shall expend money from the fund, upon
appropriation, only for the purpose of employing eligible low-
income students in the Michigan summer sweep program.
