A bill to prohibit certain electronic devices in certain
licenses; and to prohibit certain access to databases by foreign
countries.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. As used in this act, "radio frequency identification
device" means an electronic device that stores information and is
designed to transmit that information by means of radio waves to a
receiver.
Sec. 2. Any license issued under any law of this state that
authorizes the licensee to operate a motor vehicle, or any
supplement issued in conjunction with any of those licenses, shall
not contain either of the following:
(a) A radio frequency identification device.
(b) Any other device capable of having stored information read
by a remote receiver, if the device and remote receiver can share
information when they do not have a clear line of sight between
them.
Sec. 3. (1) Except as provided in subsection (2), this state
shall not provide any foreign country with information relating to
the issuance of licenses described in section 2, including, but not
limited to, allowing access to its electronic databases.
(2) Subsection (1) does not prohibit an officer or agency of
this state from providing pertinent information contained in a
database described in subsection (1) in either of the following
instances:
(a) In connection with specific individual criminal
investigations being conducted by a law enforcement agency of a
foreign country in conjunction with the international criminal
police organization or other federally authorized foreign entity.
(b) As currently allowed by any state law enacted before
December 31, 2007, for any license program operational before
December 31, 2007.
(3) Except as provided in subsections (2) and (4), this state
shall not provide any nongovernmental third party entity with
information relating to the issuance of licenses described in
section 2, including, but not limited to, allowing access to its
electronic databases, if the third party is allowed to share that
information with foreign countries.
(4) Subsection (3) does not prohibit an officer or agency of
this state from providing information contained in a database
described in subsection (1) to a nongovernmental third party entity
as currently allowed by any state law enacted before December 31,
2007, for any license program operational before December 31, 2007.
