A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding part 86.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
PART 86. AGRICULTURE
Sec. 8601. As used in this part:
(a) "Department" means the department of environmental
quality.
(b) "Director" means the director of the department.
(c) "Farm" means that term as defined in section 2 of the
Michigan right to farm act, 1981 PA 93, MC 286.472.
(d) "Farm operation" means that term as defined in section 2
of the Michigan right to farm act, 1981 PA 93, MC 286.472.
Sec. 8603. The department shall not act upon a complaint
against a farm or farm operation under this act unless the
complainant provides the department with his or her name and
address.
Sec. 8605. If a complainant brings more than 3 unverified
complaints under this act against the same farm or farm operation
within 3 years, the director may order the complainant to pay to
the department the full costs of investigation of the fourth or any
subsequent unverified complaint against the same farm or farm
operation.
Enacting section 1. This amendatory act takes effect 180 days
after the date it is enacted.
