A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
(MCL 750.1 to 750.568) by adding section 365a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 365a. (1) A peace officer, firefighter, or medical first
responder who, at the scene of a motor vehicle accident, steals any
property from a person involved in that accident or from a motor
vehicle involved in that accident is guilty of a felony punishable
by imprisonment for not more than 20 years or a fine of not more
than $10,000.00, or both.
(2) As used in this section:
(a) "Firefighter" means that term as defined in section 2 of
the public safety officers benefit act, 2004 PA 46, MCL 28.632.
(b) "Medical first responder" means that term as defined in
section 20906 of the public health code, 1978 PA 368, MCL
333.20906.
(c) "Peace officer" means 1 or more of the following:
(i) A police officer of this state or a political subdivision
of this state.
(ii) A police officer of any entity of the United States.
(iii) The sheriff of a county of this state or the sheriff's
deputy.
(iv) A public safety officer of a college or university who is
authorized by the governing board of that college or university to
enforce state law and the rules and ordinances of that college or
university.
(v) A motor carrier safety officer of the department of state
police.
