A SUMMARY OF HOUSE BILL 4362 AS INTRODUCED 2-19-09
The bill would amend the Public Transportation Act by adding section 58 to prohibit a school bus driver from using a cellular telephone while the school bus was in motion, or at any time when pupils were boarding or exiting the bus.
A person who violated the section would be responsible for a civil infraction and could be ordered to pay a civil fine of not more than $100.00. A civil infraction would be processed in the same manner as a civil infraction under the Michigan Vehicle Code.

FISCAL IMPACT:
There would be an indeterminate fiscal impact on the judiciary. Any fiscal impact would depend on the number of civil infraction violations coupled with the increase in administrative and court costs in processing the violations. Any fine revenue received from a civil infraction would go to the support of county public libraries.
