SUMMARY OF THE BILL AS INTRODUCED:

The bill amends section 226 (2)(c) of the Mental Health Code in which community mental health services programs (CMHSPs) are allowed to carry forward the operating margin up to 5% of its state share of the operating budget for fiscal years ending September 30, 2005, 2006, 2007, and 2008.  House Bill 5126 amends the Code by eliminating the sunset provisions for the carry forward of funds by CMHSPS.

FISCAL IMPACT:

House Bill 5126 has state fiscal implications.  Removing the sunset provision that allows CMHSPs to carry forward has an impact on the amount of funds that would otherwise lapse to the state. 

According to information from the Department of Community, CMHSPs carried forward $6.9 million in FY 2004-05, $6.2 million in FY 2005-06, $5.4 million in FY 2006-07, and an estimated $5.3 million in FY 2007-08.
