SUBSTITUTE FOR
SENATE BILL NO. 382
A bill to amend 1984 PA 431, entitled
"The management and budget act,"
(MCL 18.1101 to 18.1594) by adding section 447.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 447. (1) Not later than October 1, 2010, the department
shall develop and operate a searchable website accessible by the
public at no cost that includes, but is not limited to, all of the
following:
(a) The fiscal year-to-date expenditures by department and
category.
(b) The number of active employees by department and job
classification.
(c) A listing of state contracts that includes, but is not
limited to, all of the following:
(i) The funding state agency.
(ii) Vendor name.
(iii) Category code.
(iv) Contract amount.
(v) Contract description.
(vi) A hyperlink to the contract.
(d) The executive budget.
(e) The comprehensive annual financial report, the
constitutional revenue limit report, the constitutional local
spending requirements report, annual work projects reports,
detailed financial schedules, and monthly financial reports.
(f) The annual workforce report.
(g) Job specifications and wage rates.
(2) Beginning October 1, 2011, the website developed and
operated under subsection (1) shall also include a listing of
fiscal year-to-date payments displayable by vendor that includes,
but is not limited to, all of the following:
(a) The funding state agency.
(b) Vendor name.
(c) Payment date.
(d) Payment amount.
(e) Payment description.
(3) When the department replaces the state's centralized
accounting system (Michigan administrative information network),
the department shall develop and operate a replacement searchable
website accessible by the public at no cost that, in addition to
the content specified in subsections (1) and (2), includes the
following information regarding the expenditure of state funds:
(a) Name and principal location of the entity receiving the
funds.
(b) Amount of state funds.
(c) Type of transaction.
(d) Funding state agency.
(e) Budget source of the funds.
(f) A description of the purpose of the funding action or
expenditure.
(4) This section does not require disclosure of information
that is considered confidential under state or federal law.
(5) As used in this section:
(a) "Expenditure of state funds" means the expenditure of all
appropriated or nonappropriated funds by a state agency that
includes, but is not limited to, all of the following:
(i) State purchases.
(ii) Contracts and subcontracts.
(iii) Grants.
(b) "Searchable website" means a website that allows the
public to search and review the information specified in this
section.
