A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
(MCL 750.1 to 750.568) by adding section 499.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 499. (1) A person at the scene of an emergency who knows
that another person is exposed to or has suffered grave physical
harm shall give reasonable assistance to the exposed person, unless
doing so would expose the person or others to danger or peril. As
used in this section, "reasonable assistance" means contacting a 9-
1-1 operator or other law enforcement or emergency service.
(2) Subsection (1) does not apply if either of the following
applies:
(a) Reasonable assistance is already being provided.
(b) Compliance with the requirement of subsection (1) would
interfere with performing important duties owed to others.
(3) A person who violates this section is guilty of a
misdemeanor punishable by 1 or more of the following:
(a) Community service for not more than 360 hours.
(b) Imprisonment for not more than 60 days.
(c) A fine of not more than $2,500.00.
