A bill to amend 1939 PA 280, entitled
"The social welfare act,"
(MCL 400.1 to 400.119b) by adding section 105c.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 105c. (1) At the time an adult applies for or renews an
application for medical assistance under this act, the department
shall provide to that adult applicant written information regarding
the statewide advance health care directive registry. The written
information shall include, but shall not be limited to, all of the
following:
(a) Information explaining advance health care directives and
how they work, what purpose the statewide advance health care
directive registry serves, and the option for the hospice and
palliative care information within the statewide advance health
care directive registry.
(b) A form that allows the adult applicant to register for the
statewide advance health care directive registry. This form may be
completed and returned along with any other forms or applications
required when applying for or renewing medical assistance benefits.
(c) Where to find information regarding the statewide advance
health care directive registry on the public websites of the
department, the department of community health, and the secretary
of state.
(2) If the department receives a form to register for the
statewide advance health care directive registry as allowed under
subsection (1), the department shall provide that form to the
secretary of state for input into the statewide advance health care
directive registry.
Enacting section 1. This amendatory act does not take effect
unless Senate Bill No.____ or House Bill No. 4942(request no.
03072'09) of the 95th Legislature is enacted into law.
