A bill to amend 1956 PA 218, entitled
"The insurance code of 1956,"
(MCL 500.100 to 500.8302) by adding section 2026b.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 2026b. The president or chief executive officer or an
individual serving in an equivalent position for an insurer to whom
section 2026a or 3149 applies who knowingly creates, fosters, or
encourages an environment that leads to systemic wrongful denial of
claims because of the violation of section 2026a or 3149, as
applicable, is guilty of a felony punishable by imprisonment for up
to 4 years or a fine of not more than $50,000.00, or both.
Enacting section 1. This amendatory act does not take effect
unless all of the following bills of the 95th Legislature are
enacted into law:
(a) House Bill No. 4844.
(b) Senate Bill No. ____ or House Bill No. 5148(request no.
03544'09 a).
(c) Senate Bill No. ____ or House Bill No. ____ (request no.
03545'09).
