     A bill to amend 1939 PA 280, entitled

 

"The social welfare act,"

 

(MCL 400.1 to 400.119b) by adding section 10c.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 10c. (1) An individual who is enrolled in a state

 

institution of higher education who is claimed by his or her parent

 

or guardian for federal income tax purposes is not eligible to

 

receive food assistance benefits.

 

     (2) As used in this section:

 

     (a) "Food assistance benefits" means the federal supplemental

 

nutrition assistance program administered by the state.

 

     (b) "State institution of higher education" means a public

 

community or junior college established under section 7 of article

 


VIII of the state constitution of 1963 or part 25 of the revised

 

school code, 1976 PA 451, MCL 380.1601 to 380.1607, or a state

 

university described in section 4, 5, or 6 of article VIII of the

 

state constitution of 1963.
