A bill to create the Michigan new economy commission; to
provide for its operation; to impose duties on certain state and
local officials; to make recommendations and make certain reports;
and to repeal acts and parts of acts.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. (1) The Michigan new economy commission is created
within the executive office of the governor.
(2) The Michigan new economy commission shall consist of the
following members:
(a) The president of the Michigan strategic fund or his or her
designee.
(b) The director of the Michigan state housing development
authority or his or her designee.
(c) The director of the state transportation department or his
or her designee.
(d) The superintendent of public institution or his or her
designee.
(e) The following members appointed by the governor, who shall
be representative of this state geographically, racially, and with
regard to gender.
(i) One member of the house of representatives from a list of 2
or more members selected by the speaker of the house of
representatives.
(ii) One member of the house of representatives from a list of
2 or more members selected by the minority leader of the house of
representatives.
(iii) One member of the senate from a list of 2 or more members
selected by the majority leader of the senate.
(iv) One member of the senate from a list of 2 or more members
selected by the minority leader of the senate.
(v) One member representing new economy businesses.
(vi) One member representing cultural institutions.
(vii) One member representing institutions of higher education.
(viii) One member representing regional economic development.
(ix) One member representing small businesses.
(x) One member representing young professional organizations.
(xi) One member representing leadership organizations.
(xii) One member representing business media.
(xiii) One member representing foundations.
(xiv) One member representing early state business financing.
(xv) One member representing cities, villages, and townships.
(xvi) Four members, at large.
(3) The members first appointed to the Michigan new economy
commission shall be appointed within 30 days after the effective
date of this act.
(4) Members of the Michigan new economy commission shall serve
for terms of 4 years or until a successor is appointed, whichever
is later, except that of the members first appointed 8 shall serve
for 1 year, 8 shall serve for 2 years, and 7 shall serve for 3
years.
(5) If a vacancy occurs on the Michigan new economy
commission, the governor shall make an appointment for the
unexpired term in the same manner as the original appointment.
(6) The governor may remove a member of the Michigan new
economy commission for incompetency, dereliction of duty,
malfeasance, misfeasance, or nonfeasance in office, or any other
good cause.
(7) The first meeting of the Michigan new economy commission
shall be called by governor. At the first meeting, the Michigan new
economy commission shall elect from among its members a chairperson
and other officers as it considers necessary or appropriate. After
the first meeting, the Michigan new economy commission shall meet
at least quarterly, or more frequently at the call of the
chairperson or if requested by 10 or more members.
(8) A majority of the members of the Michigan new economy
commission constitute a quorum for the transaction of business at a
meeting of the Michigan new economy commission. A majority of the
members present and serving are required for official action of the
Michigan new economy commission.
(9) The business that the Michigan new economy commission may
perform shall be conducted at a public meeting of the Michigan new
economy commission held in compliance with the open meetings act,
1976 PA 267, MCL 15.261 to 15.275.
(10) A writing prepared, owned, used, in the possession of, or
retained by the Michigan new economy commission in the performance
of an official function is subject to the freedom of information
act, 1976 PA 442, MCL 15.231 to 15.246.
(11) Members of the Michigan new economy commission shall
serve without compensation. However, members of the Michigan new
economy commission may be reimbursed for their actual and necessary
expenses incurred in the performance of their official duties as
members of the Michigan new economy commission.
(12) The Michigan new economy commission shall do all of the
following:
(a) Develop a statewide strategy for the enhancement,
encouragement, and growth of the new economy in this state and to
promote through public and private means responsive public policies
and innovative private sector practices.
(b) Research and evaluate studies conducted within this state
and in other states to locate and identify best practices that
easily transfer to this state.
(c) Provide recommendations on restructuring economic programs
within state government to enhance new economy efforts.
(d) Provide strategies and propose legislation, if necessary,
to provide linkage between programs to enhance the new economy.
(e) Establish metrics to measure the effect of the new economy
on other sectors of the economy by developing and conducting
extensive statewide research and creating a database from the
results.
(f) Foster education and workforce development in the new
economy sector by stimulating efforts to develop career pathways
for new industries.
(g) Research the potential for an online resource directory,
including, but not limited to, the development and promotion of a
web-based resource highlighting the new economy and its member
companies and organizations.
(h) Research the potential for a comprehensive communications
program targeting member communities, organizations, stakeholders,
and interested parties, including, but not limited to, the
promotion of networking across the new economy sector.
(i) Research methods to brand Michigan as a new economy
leader.
(j) Develop a strategic vision for this state that includes,
but is not limited to, all of the following:
(i) Economic development.
(ii) International issues.
(iii) Outdoor recreation.
(iv) Land use.
(v) Transit.
(vi) Green initiatives.
Sec. 2. The Michigan new economy commission shall report to
the governor the results of its investigation and study, and its
recommendations together with drafts of legislation, if any, on or
before July 1, 2011.
Sec. 3. The Michigan new economy commission shall annually
submit on or before December 1 a written report of its activities
during the previous fiscal year to the clerk of the house of
representatives and the secretary of the senate. The report shall
include recommendations to the governor regarding proposed changes
to this act, or any other statute or any rule promulgated pursuant
to state law, necessary to promote the new economy in this state.
Sec. 4. This act is repealed on October 1, 2015.
