A SUMMARY OF HOUSE BILL 4326 AS INTRODUCED 2-23-11

House Bill 4326 would amend Section 32 of the Administrative Procedures Act by adding a section stating no state agency can promulgate or adopt a rule more stringent than the applicable federal standard unless specifically authorized by law.

FISCAL IMPACT:

The bill would have an indeterminate fiscal impact on the state, depending on how it would impact administrative rules promulgated by the several state departments and agencies.  There are recent examples of departments attempting to promulgate rules beyond what is minimally required under federal law or regulation, although there is substantial dispute over the estimated compliance costs of those rules.
