A SUMMARY OF HOUSE BILL 5536 AS INTRODUCED 4-17-12

The bill would amend the Michigan Vehicle Code to increase the civil fine for parking in a space reserved for a disabled person to a minimum of $200 and a maximum of $500.  Currently, the fine is a minimum of $100 and a maximum of $250.

The bill also would specify that if a parking space is identified by an official sign as being reserved for use by disabled persons, the parking space could also be posted with a sign specifying the amount of the fine authorized under the code.

FISCAL IMPACT:

The bill would have an indeterminate fiscal impact on local governments. To the extent that the bill increases civil fine revenue per offense, public libraries (which receive any civil fine revenue collected) would see an increase in revenue.

To the extent that posting the amount of any possible fine may discourage committing a civil infraction, the number of citations issued under this statue may decrease by an indeterminate amount, which would reduce revenue to local libraries, as well as reduce caseloads of local courts.
