CONTENT The bill would amend Part 309 (Inland Lake Improvements) of the Natural Resources and Environmental Protection Act to revise procedures for the dissolution of a lake improvement board.

Under Part 309, a lake board for a public inland lake is dissolved if the governing body of each local unit in which all or part of the lake is located holds a public hearing on the proposed dissolution, determines that the board is no longer necessary for the improvement of the lake because the reasons for its establishment no longer exist, and approves the dissolution of the board. The bill would eliminate the reference to a public inland lake in this provision.


Currently, the governing body of each local unit may hold the public hearing on the dissolution of the board on its own initiative, but must hold one upon petition of two-thirds of the owners of property abutting the lake. Under the bill, the provision allowing each governing body to hold the hearing on its own initiative still would apply in the case of a public inland lake. For a public or private inland lake, each governing body would have to hold a public hearing upon petition of at least two-thirds of the abutting property owners, or upon petition of the property owners who had been assessed at least two-thirds of the cost of the most recent improvements, excluding the amount assessed to local units at large.
