SUBSTITUTE FOR

SENATE BILL NO. 700

     A bill to amend 1961 PA 236, entitled

"Revised judicature act of 1961,"

by amending section 8316 (MCL 600.8316).

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

     Sec. 8316. (1) District judges and magistrates shall have

authority to may perform marriages and shall charge a fee of $10.00

which fees that shall be deposited in the treasury of the district

control unit at the end of each month. A fee paid under this

section shall be remitted to the district court in which the

district judge or magistrate performing the marriage serves.

     (2) A district judge or magistrate may waive the fee for

performing a marriage ceremony if the parties to the marriage are

indigent.

     Enacting section 1. This amendatory act does not take effect

unless Senate Bill No. 698 of the 96th Legislature is enacted into

law.
