CONTENT

 

The bill would amend the Michigan Liquor Control Code to revise the Code's provision on how it must be construed, and to limit the Liquor Control Commission's administration of the Code.

 

The Code provides that it must be liberally construed to effect the intent and purposes set forth in it.  The bill instead specifies that the Code would have to be construed to effect the intent and purposes set forth in it and to protect the public health, safety, and welfare of the citizens of Michigan.

 

Under the bill, in administering the Code, the Commission could adopt rules, orders, bulletins, declaratory rulings, or other administrative directives only if they were consistent with and not in conflict with the Code.  To the extent any rule, order, bulletin, declaratory ruling, or other administrative directive of the Commission was inconsistent with or in conflict with any provision of the Code, it would be void and not enforceable.
