CONTENT

 

The bill would amend the Michigan Liquor Control Code to prohibit the Liquor Control Commission from requiring that a new or transferred specially designated distributor (SDD) license be a certain distance from the site of an existing SDD.

 

Specifically, the bill would prohibit the Commission, notwithstanding R 436.1133 of the Michigan Administrative Code, from requiring that a proposed licensed establishment for a new SDD license or for a transfer of an existing SDD license be located a certain distance from an existing SDD's licensed establishment.

 

(R 436.1133 prohibits the approval of a new SDD license if there is an existing SDD license located within one-half mile of the proposed site. The Commission may waive the rule under certain circumstances.)

 

The Code defines "specially designated distributor" as a person engaged in an established business licensed by the Commission to distribute spirits and mixed spirit drink in the original package for consumption off the premises.
