CONTENT
The bill would amend Public Act 566 of 1978, which prohibits a public officer or employee from holding incompatible public offices at the same time, to provide that the prohibition would not prohibit the mayor, the chief executive officer, of a member of the governing body of a qualified city from serving as a member of a financial review commission for that city as established under the Michigan Financial Review Commission Act (proposed by Enrolled House Bill 5566).
"Qualified city" would mean that term as defined in the Financial Review Commission Act, i.e., a city with a population of more than 600,000 that is subject to a plan for adjustment of its debts approved and entered by a U.S. bankruptcy court under Chapter 9 of Title 11 of the United States Code. (Detroit will meet those criteria when its plan for adjustment has been entered and approved by the U.S. bankruptcy court.)
