LEGISLATURE: OATH OF OFFICE H.B. 5781:
SUMMARY OF DISCHARGED BILL
House Bill 5781 (as discharged)
Sponsor: Representative Matt Lori
Senate Committee: Government Operations
CONTENT
The bill would amend an 1846 statute entitled, "Of the legislature", to allow the Secretary of the Senate and the Clerk of the House to administer the oath of office to a member or officer of the Senate or House of Representatives.
Currently, the oath of office may be administered by any justice of the Michigan Supreme Court, the Lieutenant Governor, the president pro tempore of the Senate, the Speaker of the House, or the "chancellor". The bill would delete the reference the chancellor and add the Secretary of the Senate and the Clerk of the House.
The bill also would repeal Section 6 of Public Act 67 of 1877, which provides for the organization of the Legislature. Under Section 6, if the president of the Senate or one of the Supreme Court justices cannot attend to administer the oath of office, the officers required by the Act to organize meetings of the Legislature are authorized to administer the oath of office to the elected members of their respective chambers.
