A bill to amend 1979 PA 94, entitled
"The state school aid act of 1979,"
(MCL 388.1601 to 388.1896) by adding section 90.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 90. (1) The school mascot reimbursement fund is created
within the state treasury.
(2) The money in the restricted account under section 478 of
the executive organization act of 1965, 1965 PA 380, MCL 16.578, is
appropriated for 2012-2013 to the school mascot reimbursement fund.
The state treasurer may receive money or other assets from any
other source for deposit into the fund. The state treasurer shall
direct the investment of the fund. The state treasurer shall credit
to the fund interest and earnings from fund investments.
(3) Money in the fund at the close of the fiscal year shall
remain in the fund and shall not lapse to the general fund.
(4) The department shall be the administrator of the fund for
auditing purposes.
(5) The department shall expend money from the fund, upon
appropriation, only for distribution to districts to reimburse them
for the cost of mascots, uniforms, signage, billboards, gym
resurfacing, flags, and other expenses that are made necessary as a
direct result of the complaint dated February 8, 2013 that the
department of civil rights filed with the United States department
of education.
(6) The money in the school mascot reimbursement fund is
appropriated for 2012-2013 for the purposes of this section. A
district seeking reimbursement for an expense described in
subsection (5) shall apply to the department for that reimbursement
in a form and manner prescribed by the department.
Enacting section 1. This amendatory act does not take effect
unless Senate Bill No.____ or House Bill No. 4734(request no.
02230'13) of the 97th Legislature is enacted into law.
