A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
(MCL 257.1 to 257.923) by adding section 682d.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 682d. (1) A local unit of government may, by resolution,
authorize employees and volunteers of a charitable organization to
conduct fund-raising activities within the improved portion of a
street or highway that is within the jurisdiction of that local
unit of government.
(2) A resolution adopted under subsection (1) shall specify
the name of the charitable organization and the dates and times
when and the locations at which those fund-raising activities can
take place and may specify requirements for, and limitations on,
the use of the street or highway.
(3) The prohibitions under this act against an individual
standing, walking, or otherwise remaining within the improved
portion of a street or highway do not apply to an individual who is
conducting fund-raising activities in compliance with a resolution
adopted by a local unit of government under this section.
(4) As used in this section:
(a) "Charitable organization" means an entity organized under
section 501c(3) of the internal revenue code, 26 USC 501c(3).
(b) "Local unit of government" means either of the following:
(i) A city or village.
(ii) A county or township for those areas outside the
jurisdiction of a city or village.
