HOUSE BILL No. 5126

     A bill to amend 1976 PA 451, entitled

 

"The revised school code,"

 

(MCL 380.1 to 380.1852) by adding section 1308a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1308a. (1) The safe and secure schools fund is created

 

within the state treasury.

 

     (2) The state treasurer shall deposit into the safe and secure

 

schools fund money received under section 1j(7) of chapter IX of

 

the code of criminal procedure, 1927 PA 175, MCL 769.1j. The state

 

treasurer shall maintain separate accounts in the fund for each

 

school district and shall deposit into the account for a school

 

district all money received under that section that is received due

 

to an offense that occurred in that school district. The state


 

treasurer also may receive money or other assets from any other

 

source for deposit into the fund. The state treasurer shall direct

 

the investment of the fund. The state treasurer shall credit to the

 

fund interest and earnings from fund investments.

 

     (3) Money in the safe and secure schools fund at the close of

 

the fiscal year shall remain in the fund and shall not lapse to the

 

general fund.

 

     (4) The department shall be the administrator of the safe and

 

secure schools fund for auditing purposes.

 

     (5) Subject to subsection (6), the department shall expend

 

money from a school district account in the safe and secure schools

 

fund, upon appropriation, only for providing a grant to that school

 

district for 1 or more of the following purposes:

 

     (a) Separating public entry points from classrooms and

 

hallways leading to classrooms.

 

     (b) Emergency notification systems to notify local law

 

enforcement of an emergency, in order to decrease response time.

 

     (c) Hiring security personnel.

 

     (d) Improving external windows to make them bullet-proof.

 

     (e) Training teachers and other personnel in emergency

 

response procedures.

 

     (f) Purchasing metal detectors.

 

     (g) Obtaining professional services to evaluate safety and

 

security issues at school.

 

     (h) Funding local law enforcement overtime costs for

 

patrolling for extracurricular events or events occurring during

 

school hours.


 

     (i) Funding security for transportation of pupils for

 

authorized school trips or other off-site activities.

 

     (j) Another project that is designed to improve safety and

 

security at school, is identified by the school district, and is

 

approved by the superintendent of public instruction.

 

     (6) The department may expend money in the safe and secure

 

schools fund that is not in any school district account, upon

 

appropriation, for providing a grant to any school district for a

 

purpose described in subsection (5). If the department determines

 

that a school district that has received 1 or more grants under

 

subsection (5) does not have any further need for an additional

 

grant under subsection (5), the department may expend money in that

 

school district's account in the fund, upon appropriation, for

 

providing a grant to any other school district for a purpose

 

described in subsection (5).

 

     Enacting section 1. This amendatory act does not take effect

 

unless Senate Bill No.____ or House Bill No. 5127 (request no.

 

03654'13) of the 97th Legislature is enacted into law.
