A bill to amend 1929 PA 16, entitled
"An act to regulate the business of carrying or transporting,
buying, selling or dealing in crude oil or petroleum or its
products, through pipe lines; to authorize the use of public
highways and the condemnation of private property; to regulate the
purchase and storage of crude oil or petroleum; to provide for the
control and regulation of all corporations, associations and
persons engaged in such business, by the Michigan public utilities
commission; to define the powers and duties of the commission in
relation thereto; and to prescribe penalties for violations of the
provisions hereof,"
by amending section 2 (MCL 483.2).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec.
2. (1) For the purpose of acquiring To acquire necessary
right-of-ways,
every such rights-of-way, a corporation,
association, or
person is hereby granted the right of condemnation
described
in section 1 may condemn by eminent
domain , and the
may
use
of the highways in this state
, for the purpose of transporting
for any of the following purposes:
(a)
To transport petroleum by pipe
lines, and the location,
laying,
constructing, maintaining and operations thereof; and such
condemnation
pipelines.
(b) After receiving approval under this act as required for
crude oil or petroleum, to transport by pipeline gaseous or liquid
substances, consisting primarily of carbon dioxide, that will be
put in storage or that have been or will be used to produce
hydrocarbons in secondary or enhanced recovery operations.
(c) To locate, lay, construct, maintain, and operate pipelines
under subdivision (a) or (b).
(2) Condemnation proceedings under subsection (1) shall be
conducted
in accordance with the same procedure and in the same
manner
as is provided by the laws of this state for the
condemnation
of right-of-ways by railroad companies.as provided in
the uniform condemnation procedures act, 1980 PA 87, MCL 213.51 to
213.75.
Enacting section 1. This amendatory act does not take effect
unless all of the following bills of the 97th Legislature are
enacted into law:
(a) House Bill No. 4885.
(b) Senate Bill No.____ or House Bill No. 5254 (request no.
