A bill to amend 1939 PA 178, entitled
"An act to provide for the collection of water or sewage system
rates, assessments, charges, or rentals; and to provide a lien for
water or sewage system services furnished by municipalities as
defined by this act,"
(MCL 123.161 to 123.167) by adding section 5a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 5a. (1) Except as otherwise provided in subsection (2),
if a municipally owned water distribution system installs a new
water meter after the effective date of the amendatory act that
added this section, that municipally owned water distribution
system shall not charge the customer for any water usage that was
not previously detected or billed.
(2) If a municipally owned water distribution system provides
notice in writing to a customer of a new water meter installation
at least 3 times in a 6-month period and that customer refuses to
allow the installation of a new water meter, the municipally owned
water distribution system may charge that customer for any water
usage that was not previously detected or billed.
