SUMMARY:

House Bill 4295 amends the Code of Criminal Procedure to specify that a violation of MCL 750.227c – possessing a loaded firearm or pneumatic gun in or upon a vehicle – is punishable by a maximum term of imprisonment of two years.  The bill would take effect 90 days after enactment and is tie-barred to House Bill 4155.  (The underlining denotes the proposed change.)

(House Bill 4155, among other things, makes it a two-year misdemeanor to transport or possess on a sailboat or a motor vehicle, aircraft, motorboat, or other vehicle propelled by mechanical means, a pneumatic gun that is loaded and that is designed, manufactured, and intended to inflict death or serious bodily injury.  Two-year misdemeanors may, in some circumstances, be treated as felony offenses and so are included in the sentencing guidelines.  House Bill 4155 was previously passed by the House.)
