CONTENT

 

The bill would amend the handgun licensure law to do the following:

 

 --    Provide that a police officer would not be required to obtain a license to purchase, carry, possess, use, or transport a pistol.

 --    Require the seller's record of a pistol sale to a police officer to include the number of the officer's certificate under the Commission on Law Enforcement Standards Act.

 

Section 2 of the handgun licensure law prohibits a person from purchasing, carrying possessing, or transporting a pistol in Michigan without first having obtained a license for the pistol. The following individuals, however, are not required to obtain a license under Section 2:

 

 --    A person who holds a concealed pistol license (CPL) under the law.

 --    A federally licensed firearms dealer.

 --    A person who buys a pistol from a federally licensed firearms dealer in compliance with Federal law.

 

If one of those people purchases or otherwise acquires a pistol, the seller must complete a record in triplicate on a form provided by the Department of State Police. The record must include the buyer's CPL number or Federal dealer license number. If the buyer is neither a CPL holder nor a federally licensed firearms dealer, the record must include the license number of the federally licensed firearms dealer who is selling the pistol.

 

Under the bill, an individual currently employed as a police officer, certified under the Commission on Law Enforcement Standards Act, also would not be required to obtain a license under Section 2. The seller's record would have to include the number of the officer's certificate issued under that Act.

 

The bill would take effect 90 days after its enactment.
