CONTENT
The bill would amend the Michigan Vehicle Code to require the Secretary of State to forward a person's digital photographic image and signature located on that person's operator's or chauffeur's license to the Department of State Police for use on a license to carry a concealed pistol.
The Code lists the information and materials that an individual applying for an operator's license or chauffeur's license to operate a noncommercial motor vehicle must provide to the Secretary of State. An applicant who applies for an operator's or chauffeur's license may have his or her image and signature captured or reproduced when the application is made.
A digital photographic image and signature captured during the application process must appear on the applicant's operator's or chauffeur's license, and must be used as follows:
-- By a Federal, State, or local governmental agency for a law enforcement purpose authorized by law.
-- By the Secretary of State for a use specifically authorized by law.
-- By the Secretary of State for forwarding to the Department of State Police the images of people required to be registered under the Sex Offenders Registration Act, when the Department provides the Secretary of State an updated list of the names of those people.
-- As necessary to comply with State or Federal law.
The bill also would require a person's digital photographic image and signature to be used by the Secretary of State for forwarding to the Department for use as provided in Section 5c of the handgun licensure law (Public Act 372 of 1927).
(Section 5c prescribes the form and design of a concealed pistol license, and requires the license to contain specified information, including a photograph and a physical description of the licensee.
Section 5c also requires the Secretary of State to make a digitized photograph taken of the applicant for a driver license or personal identification card available to the Department of State Police. The Department must provide the photo of the applicant to the county clerk, who must use it on the individual's concealed pistol license unless the applicant does not have a digitized photograph on file with the Secretary of State. Under that circumstance, an applicant must provide a passport-quality photograph of himself or herself.)
