CONTENT

 

The bill would amend the Code of Criminal Procedure to revise sentencing guidelines references to sections of the Michigan Vehicle Code pertaining to violations concerning breath alcohol ignition interlock devices (BAIIDs).

 

Under the Code of Criminal Procedure, knowingly providing false information concerning an ignition interlock device and failure to report an illegal ignition interlock device both are Class D public safety felonies, with a statutory maximum penalty of 10 years' imprisonment. The bill would revise the MCL citations for those offenses (which would make them consistent with changes proposed by Senate Bill 176).

 

The bill would take effect 90 days after its enactment and is tie-barred to Senate Bill 176. (That bill would amend the Michigan Vehicle Code to revise the regulation of the manufacture, sale, installation, service, and use of BAIIDs. It would retain the offenses to which House Bill 4980 would apply, but move them to a different section of the Vehicle Code.)
