USE OF DRIVER LICENSE PHOTO FOR CPL H.B. 5250:
SUMMARY OF BILL
REPORTED FROM COMMITTEE
House Bill 5250 (as reported without amendment)
Sponsor: Representative Ed Canfield
House Committee: Transportation and Infrastructure
Senate Committee: Transportation
CONTENT
The bill would amend the Enhanced Driver License and Enhanced Official State Personal Identification Card Act to allow the Secretary of State to forward a facial image or signature located on an enhanced driver license or enhanced official State personal identification card to the Department of State Police for use on a license to carry a concealed pistol.
The Act lists the information and materials that an individual applying for an enhanced driver license or enhanced official State personal identification card must provide to the Secretary of State. An applicant must have his or her facial image and signature captured or reproduced by the Secretary of State at the time of the application.
A person's facial image or signature may be made available by the State and used by a Federal, State, or local government agency for any law enforcement purposes authorized by law; by another state to the extent required by Federal law; by the Secretary of State for any purpose specifically authorized by law; for any other purpose as determined by the Secretary of State, if a person provides his or her written authorization for the release of his or her own facial image or signature; or as otherwise required by law.
The bill also would allow a person's facial image or signature to be used by the Secretary of State for forwarding to the Department of State Police for use as provided in Section 5c of the handgun licensure law.
(Section 5c prescribes the form and design of a concealed pistol license, and requires the license to contain specified information, including a photograph and a physical description of the licensee. Section 5c also requires the Secretary of State to make a digitized photograph taken of the applicant for a driver license or personal identification card available to the Department of State Police. The Department must provide the photo of the applicant to the county clerk, who must use it on the individual's concealed pistol license unless the applicant does not have a digitized photograph on file with the Secretary of State.)
