HOUSE SUBSTITUTE FOR

 

SENATE BILL NO. 985

 

 

 

 

 

 

 

 

 

 

 

 

     A bill to amend 1982 PA 295, entitled

 

"Support and parenting time enforcement act,"

 

by amending section 24a (MCL 552.624a), as amended by 2002 PA 572.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 24a. For a friend of the court case, if a support

 

arrearage has accrued and there is reason to believe the payer

 

transferred title or ownership of real or personal property without

 

fair consideration, the title IV-D agency shall initiate

 

proceedings to have the transfer set aside as provided in the

 

uniform fraudulent transfer voidable transactions act, 1998 PA 434,

 

MCL 566.31 to 566.43, 566.45, or obtain a settlement in the form of

 

full payment of the arrearage or in periodic repayments as is

 

possible in the best interest of the recipient of support.

 

     Enacting section 1. This amendatory act takes effect 90 days


after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No. 982 of the 98th Legislature is enacted into

 

law.
