HOUSE BILL No. 5313

     A bill to prescribe the powers and duties of certain providers

 

of water and sewerage service in this state; and to prohibit

 

certain acts and practices of providers of water and sewerage

 

service in this state.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. As used in this act:

 

     (a) "Advanced meter" means a meter or other device that,

 

through the use of equipment owned or leased by the provider or its

 

agent, meets 1 or more of the following requirements:

 

     (i) Is capable of measuring, recording, or sending provider

 

customer data by use of common radio waves or in any other wireless

 

manner.

 

     (ii) Allows 2-way communications suited for demand-response

 

programs.

 


     (iii) Allows for a provider's control of a customer's water

 

usage.

 

     (b) "Provider" means any water and sewerage system that

 

provides water or sewerage service in this state.

 

     Sec. 2. A provider shall not make water or sewerage service to

 

a residential customer contingent on the installation of an

 

advanced meter or use of an advanced meter function.

 

     Enacting section 1. This act takes effect 90 days after the

 

date it is enacted into law.
